August 15 2012 Bulacan foundation day holiday
The province of Bulacan will celebrate its annual foundation day (“Araw ng Bulacan“) anniversary this coming August 15, 2012. The day, which falls on a Wednesday, is a special nonworking holiday in the said province by virtue of Proclamation Presidential 443, signed by Executive Secretary Paquito Ochoa. The Philippine Star noted in an article last year that the Provincial Administrative Code of Bulacan recognizes August 15, 1578 as the founding day of the province.
According to the Department of Labor of Employment (DOLE), employees who report for work during special nonworking holidays should get an additional of 30% to their regular hourly rate. On the other hand, those who will choose to stay at home are not bound to get paid “unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment of wages on special days even if unworked.”
Be present in the work day before a holiday
As mentioned in DOLE’s Handbook on Worker’s Statutory Monetary Benefits (released in 2010), an employee is entitled to a holiday premium only when “he/she is present or is on leave of absence with pay on the work day immediately preceding the holiday.”Download the 2010 handbook in this link.
