Pay rules for December 31 2023 special non-working holiday

President Ferdinand Marcos, Jr. has declared New Year’s Eve, December 31, as a special non-working holiday nationwide. Marcos made the announcement through Proclamation 42, which was released last year. The occassion this year falls on a Sunday.

Pay Rules For December 31, 2023 holiday

According to the 2023_edition of Department and Labor and Employment’s (DOLE)_Handbook_on_Workers_Statutory_Monetary_Benefits, the “no work, no pay” principle should be in effect during special non-working holidays.

In line with this, workers who are not required or permitted to work on December 31 anywhere in the country are not entitled to receive any compensation unless there is a collective bargaining agreement or a company policy that implements that.

The handbook likewise highlighted that employees who work during special non-working days must receive an additional pay of 30% for every hour that they render service.
