#WalangPasok – January 11 2022 declared holiday in Bataan
The province of Bataan will be celebrating its 265th foundation anniversary this January 11, Tuesday. The day is a special non-working holiday as mandated by Republic Act 11138 which President Rodrigo Duterte signed into law back in 2018.
That means that there will be no classes in schools in all levels and all works in both private and government offices in the province are suspended. The full text of RA 11138 can be accessed here.
According to historian Cornelio Bascara documents, Bataan was established on January 11, 1757 by then-Governor General Pedro Manuel Andrada by merging territories erstwhile belonging to Pampanga and the corregimiento of Mariveles into a single province.
According to the 2020 DOLE handbook on workers statutory monetary benefits, the “no work, no pay” principle applies during special non-working holidays. Meaning, workers who are not required or permitted to work on special non-working days are not entitled to any compensation unless there is a collective bargaining agreement or a company policy that provides for that.
The handbook likewise highlighted that employees who work during special non-working days are entitled to receive an additional pay of 30% for every hour that they render service.
